1Introduction
These Terms form a contract between you and Waplee. Using Waplee means you agree to them.
Welcome to Waplee ("we", "us", "our"), a print-on-demand platform operated from Gill House, 1st Floor, Room 28, Nairobi, Kenya. These Terms and Conditions ("Terms") govern your access to and use of waplee.org and any related services, applications, or content we provide (together, the "Platform").
By creating an account, placing an order, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the Platform.
These Terms should be read together with our Privacy Policy and User Agreement, which form part of the contract between us.
2Definitions
- Account — the registered profile you create on the Platform.
- Content — any text, images, designs, artwork, logos, or other material you upload, create, or submit through the Platform.
- Order — a request you submit through the Platform for us to produce and deliver a customised product.
- Product — physical printed items we produce on demand, including posters, flyers, business cards, apparel, frames, wall art, and similar items.
- M-Pesa — the mobile money service operated by Safaricom PLC.
3Your Account
3.1 Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian, to create an account or place an order. By registering, you confirm that the information you provide is accurate, current, and complete.
3.2 Account security
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at hello@waplee.org if you suspect unauthorised access.
3.3 One person, one account
Each individual may maintain only one account. Business accounts may be operated on behalf of a registered entity by an authorised representative.
4Using the Platform
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for the purpose of designing and ordering Products for personal or business use, subject to these Terms.
You agree not to:
- Reverse engineer, decompile, or attempt to extract the source code of the Platform;
- Use automated tools (bots, scrapers) to access the Platform without our written permission;
- Interfere with or disrupt the Platform's operation or security;
- Resell, sublicense, or commercially exploit the Platform itself (as opposed to Products you legitimately order through it).
5Orders & Pricing
5.1 Submitting an order
When you place an Order through the Platform, you make an offer to purchase the Product on these Terms. Your Order is accepted once we confirm receipt of payment and you receive an order confirmation. We reserve the right to refuse or cancel any Order at our discretion, including (but not limited to) where the Order contains prohibited Content, suspected fraud, or pricing errors.
5.2 Pricing
All prices are quoted in Kenya Shillings (KES) and are inclusive of any applicable Value Added Tax unless stated otherwise. Pricing for each Product depends on size, material, finish, quantity, and any additional options you select, as displayed in the order modal at the time of ordering.
5.3 Pricing errors
While we make every effort to ensure pricing is accurate, errors can occur. If we identify a pricing error after you have placed an Order, we will notify you and offer the option to confirm at the corrected price or cancel for a full refund.
6Payment
Payment for Orders is processed via M-Pesa STK Push through Safaricom's Daraja platform. By initiating payment, you authorise the deduction of the Order amount from your nominated M-Pesa account.
Production of your Order does not begin until payment is confirmed. If payment fails or is reversed, your Order will not be processed, and any production already commenced may, at our discretion, be cancelled.
Note: M-Pesa transaction charges, where applicable, are determined by Safaricom and are not part of the Product price. Refer to Safaricom's M-Pesa tariffs for details.
7Production & Delivery
7.1 Production turnaround
Standard production turnaround is between 1 and 5 business days from the time of payment confirmation, depending on the Product type, quantity, and our current production load. Estimated turnaround times displayed on the Platform are indicative and not guaranteed.
7.2 Delivery
We deliver to addresses within Kenya. Delivery is fulfilled either through nominated courier services or by collection from our offices at Gill House, 1st Floor, Room 28, Nairobi. Delivery fees, where applicable, are calculated at checkout based on your selected method and destination.
7.3 Risk and title
Risk of loss or damage passes to you upon delivery to your nominated address or upon collection. Title to the Products passes to you only after we have received full payment.
7.4 Delays
We are not liable for delays caused by events outside our reasonable control, including (but not limited to) courier delays, public holidays, power outages, equipment failure, or force majeure events.
8Returns & Refunds
Because every Product is custom-made to your specifications, we generally do not accept returns or offer refunds for change of mind. However, we will replace, reprint, or refund Orders in the following cases:
- Manufacturing defects — print quality issues, material defects, or faulty workmanship attributable to us;
- Wrong product delivered — the Product you receive does not match the specifications of the Order you confirmed;
- Damage in transit — where damage is reported within 48 hours of delivery and supported by photographic evidence.
Claims must be raised within 7 days of delivery by emailing hello@waplee.org with your Order number and supporting photos. We may request return of the affected item before issuing a replacement or refund.
Refunds, where approved, are processed back to the original M-Pesa number within 7 business days.
9Intellectual Property
9.1 Your Content
You retain all ownership of Content you upload or create on the Platform. By submitting Content, you grant Waplee a non-exclusive, royalty-free, worldwide licence to use, store, reproduce, and modify the Content solely to the extent necessary to:
- Display the Content within your account and order workflow;
- Produce the Products you have ordered;
- Operate, maintain, and improve the Platform.
This licence terminates when you delete the Content from your account, except to the extent we are required to retain copies for legal, accounting, or operational reasons (such as fulfilling an in-progress Order).
9.2 Your warranties
By submitting Content, you warrant and represent that:
- You own the Content, or have all necessary rights, licences, and permissions to use it and authorise us to print it;
- The Content does not infringe any third-party intellectual property, privacy, publicity, or other rights;
- The Content complies with all applicable laws.
9.3 Our intellectual property
The Platform itself — including its software, design, branding, logos, layout, and template library — is owned by Waplee or our licensors and is protected by copyright and other intellectual property laws. Nothing in these Terms transfers any of these rights to you.
10Prohibited Uses & Content
You may not use the Platform to create, upload, order, or distribute Content that:
- Infringes any copyright, trademark, patent, trade secret, or other intellectual property right;
- Is defamatory, obscene, pornographic, hateful, or threatens or incites violence;
- Promotes discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any protected characteristic;
- Contains private or personally identifiable information of any person without their consent;
- Promotes illegal activity, controlled substances, or weapons;
- Impersonates any person or entity, or misrepresents your affiliation with any person or entity;
- Contains malware, viruses, or any malicious code;
- Violates the Computer Misuse and Cybercrimes Act, 2018 of Kenya, or any other applicable law.
We reserve the right, but not the obligation, to review, remove, or refuse to print any Content that we determine, in our sole discretion, violates these Terms or is otherwise objectionable. Repeated or serious violations may result in suspension or termination of your account.
11Intellectual Property Infringement Claims
If you believe that Content on our Platform infringes your intellectual property rights, please send a notice to hello@waplee.org with the subject line "IP Infringement Notice" containing:
- Your name, address, telephone number, and email;
- A clear identification of the work you claim is being infringed;
- A clear identification of the Content on Waplee that you allege infringes (with URLs or order references where possible);
- A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law;
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorised to act on behalf of the rights holder;
- Your physical or electronic signature.
We will investigate valid notices promptly and may remove the disputed Content, halt production, or suspend the relevant account pending resolution.
12Limitation of Liability
To the maximum extent permitted by law:
- The Platform is provided "as is" and "as available" without warranties of any kind, express or implied;
- We do not warrant that the Platform will be uninterrupted, secure, or error-free;
- Our total liability to you under these Terms for any claim, whether in contract, tort, or otherwise, will not exceed the total amount you paid to Waplee for the Order giving rise to the claim;
- We are not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including (but not limited to) lost profits, lost data, or business interruption.
Nothing in this section limits liability that cannot be limited by law, including liability for fraud, gross negligence, or wilful misconduct.
13Termination
You may close your account at any time by contacting us at hello@waplee.org.
We may suspend or terminate your account, refuse service, or refuse to fulfil any Order, with or without notice, if we reasonably believe you have violated these Terms, our User Agreement, or applicable law, or if continued service poses a risk to us or other users.
Termination does not relieve you of obligations accrued before termination, including payment for any Orders in production.
14Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of Kenya. Any dispute arising out of or in connection with these Terms or your use of the Platform will be resolved as follows:
- Direct discussion — the parties will first attempt to resolve the dispute through good-faith discussion;
- Mediation — if direct discussion fails, the parties will attempt mediation through a mediator agreed by both parties or appointed by the Mediation Accreditation Committee of Kenya;
- Courts — failing the above, the courts of Kenya, sitting in Nairobi, will have exclusive jurisdiction.
15Changes to These Terms
We may update these Terms from time to time to reflect changes in our service, the law, or our business. When we make material changes, we will post the updated Terms on this page and update the "Last updated" date at the top. For significant changes, we will provide additional notice (such as an email or a notification on the Platform).
Your continued use of the Platform after the updated Terms take effect constitutes acceptance of the changes. If you do not agree, you must stop using the Platform.
